Proposed IBC changes likely to reverse SC’s Vidarbha Industries order
The ministry of corporate affairs on Wednesday proposed that the adjudicating authority must admit an application filed by a financial creditor, provided it was established that a default was committed and that the other procedural requirement was fulfilled. It has not defined the “other procedural requirement” in the recommendations.
